India Is Likely To Get Its First Openly Gay Judge


Senior Advocate Saurabh Kirpal, who is openly gay, was proposed by the top courts collegium to become a Delhi High Court judge.



In India, there is a process of appointing a judge. First, it includes suggestions from the collegium and then a formal approval from the federal government.


Kirpal attended St.Stephen’s College at New Delhi to study physics. He eventually went to Oxford University on a scholarship for a law degree. He also has a master’s degree from Cambridge University. Kirpal’s father, BN Kirpal previously served as India’s chief justice.



Many people believe that the Prime Minister of India, Narendra Modi is likely to accept Mr.Kirpal in the coming weeks. Mr.Kirpal is very well known in India, in fact, Kirpal was the lawyer for two key petitioners in the case of the victory for the country’s LGBTQ population back in 2018. Kirpal always believed that he could be a role model for this community.

Senior lawyer Geeta Luthra told the BBC that Mr. Kirpal was “bright”, “exceptional” and “deserving”.  “Saurabh Kirpal’s personal choice of sexual partner should have no role in his recommendation for being a judge in the Delhi High Court. We have to give precedence to merit and calibre,” she added.



The Indian society still has a long way to go before it starts to treat everyone equally and without discrimination on a daily basis, but it would surely be a big step forward if the government approves Kirpal to be India’s first openly gay high court judge!
